Deeds, title and liens: follow the documents

Understand what a recorded document can tell you—and what still needs review.

6 MIN READRESEARCH FRAMEWORK

A document trail is not a guarantee

A recorded deed, assessor entry and title review answer different questions. Collect the legal description and recording references, then identify which documents a qualified title professional should examine.

Read beyond the name

Names can repeat and entities can change. Match a document to the property using the legal description and recording context. Do not treat a name match by itself as proof of ownership or a lien against your target parcel.

Record unresolved interests

Keep questions about mortgages, judgments, easements, releases and other interests in the file. A professional title examination can identify issues that a casual public-record search misses.

Ask about title protection

The CFPB explains the role of owner’s title insurance. Ask a qualified provider what protection is available for the transaction and read the policy, exceptions and conditions before relying on it.
